Divorces typically involve disputes over child custody or financial issues. Litigating these issues in court can sometimes result in decisions that dissatisfy one or both parties. Mediation can assist divorcing or separating couples by helping them reach agreement, and avoid the uncertain results that a trial may bring. The Law Offices of Randy S. Margulis & Associates offers a Certified Mediator, Alexandra Rockwood, M.S.W, ESQ., a seasoned attorney with social work training, to help you through this alternative to litigation.
The process begins with the disclosure of financial, child-related, or other relevant information from each of you, including the ultimate goals you are seeking to achieve. You both participate in the negotiation process by meeting with the Mediator to discuss and work through each issue. Ultimately, our Mediator will present you with a proposed written agreement to review, which if agreeable, will be signed by both parties, and submitted to a court for incorporation into a judicial decree. Each party reserves the right to seek his or her own independent legal representation, should you choose, but it is not mandatory. Mediation can take place virtually, or in the privacy of our Mediator’s offices. You avoid trips to the courthouse, and arrange meetings around your own schedules.
Our firm has helped thousands of people in divorce, separation, child custody and property disputes for more than three decades. We recognize that every case has the potential for settlement, and believe that having the right professionals on your side can make a significant difference. Our principal Certified Mediator, Alexandra Rockwood, M.S.W, ESQ. is an attorney, with a social work training background. This unique combination offers the skills to help you through the mediation negotiation process, with first-hand experience and knowledge of what goes on in the courtroom. This allows us to present you with potential alternative results in your case, should you take the litigation approach.
Our Mediator initiates discussion and presents you with the legal information needed to reach a resolution. The goal is to help you both reach an informed decision through negotiation and compromise, applying conflict resolution skills, knowledge of the law, and a practical approach toward settling your differences. A comprehensive final settlement agreement is then presented for both parties to consider, with independent legal representation of your own choosing an option for each party.
In addition to divorce, separation, and child custody matters, you may want to consider mediation in matters involving other situations. These may include the following:
